Terms of Use

These Terms of Use (the “Terms”) form a binding agreement between you and GoWild regarding your use of the GoWild application and any related services (the “Service”).

By creating an account, accessing, or using GoWild, you confirm that you have read, understood, and accepted these Terms.

1. Definitions

• “User”: Any individual using the App to search for and/or participate in activities.
• “Organizer”: Any company/professional/entity that posts, advertises, or organizes activities through the App.
• “Activity”: Any outdoor/nature experience/trip/activity displayed and/or organized by an Organizer.
• “Content”: Text, photos, links, activity information, profile data, and any other material displayed in the App.

2. Nature of the Service – Role of GoWild

GoWild is a platform connecting Users with Organizers. GoWild is not the organizer, provider, guide, or party responsible for the performance of Activities unless expressly stated otherwise within the relevant Activity listing as being organized by GoWild.

Any agreement regarding participation in an Activity, and the terms/rules/conditions of that Activity, is formed between the User and the Organizer.

3. Registration, account, and accuracy of information

Certain features may require registration and provision of details such as email address and mobile phone number. You must provide true, accurate, and up-to-date information.

You are responsible for:

• Maintaining the confidentiality of your account access details
• All activity occurring through your account

We reserve the right to suspend or terminate accounts in the event of violation of these Terms or abuse of the Service.

4. Use by minors

Minors may use GoWild only under the supervision of a responsible adult. The responsible adult must ensure that use is safe, appropriate, and compliant with these Terms and with the Organizer’s instructions/conditions for each Activity.

5. User content (e.g., profile photo)

Users may upload a personal profile photo. You represent and warrant that:

• You have all necessary rights to use and upload the photo
• The photo does not infringe third-party rights (e.g., copyright, personality/image rights)
• The photo is not unlawful, offensive, defamatory, threatening, or misleading

You grant us a non-exclusive license to host, reproduce, display, and technically process your Content solely for operating the Service.

We reserve the right to remove or restrict Content that violates these Terms or is reasonably deemed inappropriate.

6. Organizer content and obligations – External links

Organizers are solely responsible for:

• The accuracy, completeness, and legality of Activity information
• The safe organization and conduct of Activities
• Any required permits, certifications, insurance, compliance with safety rules and instructions
• Providing information on risks, participation requirements, difficulty level, required equipment, weather constraints, and limitations

An Organizer may attach an external link to their website. GoWild does not control and is not responsible for third-party websites or any transactions or actions you may take outside GoWild.

7. Disclaimer for accidents – Assumption of risk

Outdoor activities may involve risks (including, indicatively, injuries, weather changes, difficult terrain, animals, and unforeseen incidents). By participating in an Activity, you acknowledge the inherent risk involved.

GoWild bears no liability for any accident, injury, loss, damage, or harm of any kind arising before, during, or after your participation in an Activity. Responsibility for the safe organization and conduct of an Activity, and for compliance with safety rules, rests with the Organizer of that Activity.

You must follow the Organizer’s instructions, assess the suitability of an Activity for your physical condition/experience, and take appropriate precautions.

8. Prohibited use

You may not:

• Use the Service for unlawful purposes or in breach of these Terms
• Interfere with the operation of the App or attempt unauthorized access
• Collect other users’ data without a lawful basis or permission
• Upload/distribute malware or content that harms others
• Impersonate others or provide false information

9. Pricing – Free availability and future charges

GoWild is currently offered free of charge. We reserve the right, in the future, to introduce charging mechanisms for some or all features (e.g., subscription, per-booking/participation fee, commission, premium features).

If charges are introduced:

• You will be clearly informed before any cost is incurred
• Applicable pricing terms, refund policy (if any), and any additional terms will be posted within the App and/or communicated appropriately
• Continued use of paid features will require acceptance of the relevant terms

10. Google APIs – Third-party terms

Certain features rely on third-party services (such as Google APIs, including the Google Places API). Use of these features may be subject to additional terms of the relevant third-party providers. GoWild is not responsible for availability or malfunction of third-party services.

11. Intellectual property

GoWild, its logo, design, code, text, and other App elements are the intellectual/industrial property of GoWild or its lawful licensors and are protected by applicable law.

No rights are granted to you other than a limited, non-exclusive, non-transferable license to use the App for personal and lawful purposes in accordance with these Terms.

12. Availability – Changes – Discontinuation

We may modify, upgrade, or temporarily or permanently discontinue the App or any part of it for maintenance, security, or business reasons. We will use reasonable efforts to minimize disruption but do not guarantee uninterrupted availability.

13. Limitation of liability

To the maximum extent permitted, GoWild is not liable for:

• Acts, omissions, statements, or content of Organizers
• The quality, safety, legality, or suitability of Activities
• Transactions or communications occurring outside the App (e.g., via external links)
• Indirect or consequential damages (such as loss of profits, data, or reputation), unless mandatory law provides otherwise

14. Data protection

For personal data matters, the “Privacy Policy – GoWild” applies and forms an integral part of these Terms.

15. Amendments to Terms

We reserve the right to amend these Terms. The updated version will be posted in the App with a new “Last updated” date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

16. Governing law – Dispute resolution

These Terms are governed by Greek law. Any disputes arising out of use of the App or these Terms shall be resolved by the competent courts of Athens, unless otherwise required by mandatory law.
